    Hmmmm, thats a tough one, if the sun was low the driver could have put the sun visor does and sat up in his chair to block out the sun, but as he was not totally at fault and under the influence of alcohol or drugs or breaking the speed limit i dont see why the insurance would become void. There is something not right there!


    Sounds like the employer is trying to pull a fast one becuase he would have to pay more for the driver than he would for the passenger!

    I'm not sure about California laws, but in the constitution, it states that everyone has the right to a speedy due process. I don't think the judge can sit on it for a long period of time.

    In the first citation you posted the Supreme Court did decide that segregated public schools were a violation of the 14th Amendment and, in that decision, they overturned their previous decision in Plessy Vs. Ferguson in the 19th Century. That second citation reflected something new in the military. That was the case of female members who had male spouses and those spouses were not considered to be dependents. In any case, the Court ruled that practice to be unconstitutional. In my last overseas assignment I served with a female Navy Captain and her male spouse was considered to be a dependent husband and he had the ID card to prove it.


    In short, both cases are done and corrections were made. Anytime there is a perceived wrong with some law, that law can be challenged through a ';test case'; to determine if the law is constitutional.     Have you checked online and researched the lemon law statute for your state? In some states the lemon law applies to (brand spanking) new cars only. So even if your car is a 2006, if it was previously owned at any point and time (such as a rental) then the lemon law does not apply. And any used car would not apply either. Find this out and be certain you're covered.





    As far as an attorney, many states often have a non profit legal assistance hotline where you can get free legal advice between certain hours. If you're employed check your employee assistance program (EAP) if you have one. Many companies offer legal consultation to their employees either free and/or at a discount. You might be entitled to a free legal consult over the phone and an in office consultation at a discount.

    ok first off is it a new car if not your screwed the lemon law does not cover used cars
    You bought a 12 year old truck!!! You did not have it checked out by your own mechanic prior to purchase, or if you did he did not find a problem with it.





    You now want to blame everyone but yourself for the problem, and want a lawyer to take the case without pay!! You say the dealer is working on the car now, but you (who of course do not know anything about vehicles when you bought the truck) now are an expert on what is wrong, and you know they can not make the truck safe.





    I think you have changed your mind and want to get out of the deal. I do not think there is a lemon law case here. You are just trying to avoid responsibility for your own choices!!!

    Yes, what you said is generally true, subject to numerous qualifications (e.g. if the grand jury is not in session in the district where the charges are to be filed, the prosecution gets an additional 30 days to file an indictment; the 70-day time limit starts to run from either the filing of the indictment or the defendant's initial court appearance, whichever occurs later; etc.).

    The only example I can think of where the 'reasonable person' logic comes into play is in advertising, where a mistaken advertisement offers to sell a product for a price which no reasonable person would expect to be correct. For instance selling a car for $1.





    While the advertisement would normally be considered a binding offer, the reasonable person doctrine would allow that offer to be withdrawn, since no reasonable person would expect to get a car for $1.
    Careful with the reasonable man standard.





    Off the top of my head, in Law School we studied the case of a store running an ad stating that fur and mink coats were to be sold to the first person in line at THIS specific store at THIS specific time for THIS specific price.





    The store claimed that it didn't owe this man anything because it was simply an ad and the reasonable man would not expect to get an article of that caliber for that cheap.





    Wrong.





    An ad that is THAT specific constitutes and qualifies as a legally binding contract.





    There's all 6 elements to a contract in that ad and the relationship created by the first in line is considered the acceptance.

The sentence most likely depends on why the property was stolen, how and who the person is (like their past criminal records if any). The sentence can also change on how the verdict acts towards the judge. So your answer varies. Most likely theft.
    The actual legal names will depend on jurisdiction. Different countries use different names, and you didn't tell us where you are. If you live in a Federal country then the different States and Provinces have different names too.





    The name will also vary depending on ';how'; it was stolen. For example if you mugged a payroll clerk it might be robbery, if you broke in to her office at night it might be burglary, and if you are the payroll clerk and you took the money home with you it might be embezzlement.

    Primarily because the Supreme Court can only issue a ruling on the case at hand, not all similar related issues. Typically, a ruling such as Brown will signal a shift in social policy and other laws and changes happen on their own.

    Weather you will get it depends on a lot of things.


    But one question is who filed? Did you file or the other party? What kind of family law case is it? Is Time an issue?





    For example an ex-parte (emergancy)hearing regarding the child custody due to safety issues will never be delayed. But the orders in these cases are only temporary until a formal full hearing is made.





    If you filed the case, you may be less likely to get a delay than if the other person filed.





    There are just too many things to guess with this little infomation. There are just tooo many types of family law to try to predict if the judge will give you a delay.
    File a motion for continuance with the reasoning and serve it on the other party and file it with the court. Since it is just a motion for continuance, you don't have to make personal service. Just mail or fax the other party the motion and make sure you also file a signed and dated document stating that you sent it via fax, mail, hand delivered, etc. Make sure the signature on the affidavit for your reasoning is notarized though.





    Don't wait til the last minute though. Do it immediately so your motion will more likely be granted. As long as you are asking for the continuance in good faith and for a valid reason (seeking counsel is usually grounds) then they will probably grant it. Just make sure you state that you are actively seeking representation and that it is not meant for delay.
    If this is your first hearing then you might be able to have it adjourned in giving you time to get an attorney.


    In self representing there is only the facts of evidence that is being heard and you can't do what attorneys does professionally. You don't want the wrong words to come out and you don't want to get the judge mad with also understanding that even if you request such to be adjourned it will be up to the judge for they don't usually like adjourned hearings for their schedule is a very busy one.
    You can ask for a continuance, but it is up to the court. If the court thinks that your purpose was to delay the proceedings, or that you have had plenty of time to get counsel, then the motion for a continuance will be denied. If you ask for a reasonable continuance, and give plenty of notice, and give a decent reason why you are not ready, the motion will be granted.
    Ask for a different hearing date. This may be possible by phone, forms or by simply asking the judge. It will depend on your particular court. Check the local court website for options.





    If you can find your way around the Code of Civil Procedure for your state, you can do just about any action that is appropriate. It is all up to the judge to decide after that. You are expected to research such procedure.

    if you elected to represent yourself from the very beginning and turned down legal aid or a lawyer, its unlikely a judge will be sympathetic.. you should have thought more about your representation from the time the court issues were raised..

    The better business bureau will be of no help, they will merely notify the dealer that there is a problem with a customer, and give them a chance to reply. They have no power whatsoever.

    I recently traded my car in for a Nissan Armada and the brake light goes on while in drive. When you step on the brakes, the brakes vibrate and it seems the braking gets weaker as you depress the pedal. My atty advised to take Nissan to court rather than go thru BBB's arbitration program.     The basic rules of 'Lemon Law' are tricky, firstly take the car back to the dealer and insist that they try to rectify the problem at there cost, if they refuse or they say they have done the repairs yet the problem's still there then threaten the dealer with 'Lemon Law'. This is a complicated law and can be used when all avenues have been tried and the dealer still refuses to rectify the problem. Be quick though as all car dealers try to weasel there way out of anything.Has anyone ever had a lemon law case?
    I have a 2005 Armada and had the same problem, the dealer told me there was a recall on the brakes. The OEM brakes are not big enough,They replaced the brakes(3 months ago) I have not had a problem. If I were you I would take it to another Nissan Dealership.

    Couple of things that has effected law enforcement is the guy backing into the patrol car and making the air bag inflate, alot of patrol cars have bumper guards on front end to prevent this now.Another is the police have cameras in their cars to prove their case in court.Both these have been a result of court cases.

    Go to your local law library and ask for the reference librarian, they will help you. First, they will point you to Martindale-Hubbel - it will list the firms, associates+partners and the type of law they practice. You will also probably need Westlaw or LexisNexis - I think you could do the search in the hard copy books, but it might be tough.





    It will take some work...What are you applying for anyhow? Also, what may help, if they are willing, is the career counselor in the law school - they know the different firms, etc...Where can I look up information on law firms? Previous cases, etc!?
    lexis nexis and westlaw are def good places to start... but you should have gotten the details from their websites. just play around on the sites and you should find their grad recruitment programmes; contact details; HR depts; available positions; etc


    also, sounds silly, but try the phone book ;-)
    If you are a law student, use your Lexis or Westlaw access to search those two databases. You can find information on attorneys/firms, such as the percentage of cases they practice in, which cases they have won/lost, etc.

    Westlaw is excellent, but expensive. Findlaw isn't too bad. Lectlaw is another one.
    Findlaw.com and megalaw.com are good, you have to do some link clicking by state, federal, etc., or you can enter case name, very good for free if you've got some time and patience!

    Your state judicial website is a good source usually for local and state issues. Supreme Court decisions can be found on the Supreme Court's website.

    1) Los Angeles PD was proven to have tampered with evidence. They 'discovered' blood tainted sock in OJ's home. Well, the FIRST video of the scene clearly showed no sock. The second LAPD video magically shows the sock. Second, that drop of blood they found on that sock? It contained EDTA, a chemical preservative not found in human blood. It is however, found in blood stored in test tubes - like the test tubes of blood in LAPD custody.

    I can't really think of one that would show morality. I suggest looking up cases that deal with torts. Maybe dealing with issues of slander or libel.

    Supreme court judges are appointed for life so they owe nothing to any parties. Secondly I bet everyone has a cousin or two who works some politician or another so what?     With the benefit of 20/20 hindsight, I realize most of what I blew in law school was to fail to memorize case names. I would explain the principles involved and get them right, but be graded points off if I did not remember the case name.





    Try putting the case names on 3 x 5 cards, with a short summary of the principle illustrated on the other side, and just flash card yourself. Both sides: have someone show you the name and you give them the principle, then have them show you the principles, and you give them the name of the pivotal case.     I used to try to cram case names by: (1) shortening the name to just one or two words, (2) trying to come up with a word that starts with the same initial as the case-name that is also tied to the facts or the holding -- enough to help me remember ';what happened';, then (3) line up the initials in the order that the cases occurred chronologically, and (4) come up with some phrase that would help me remember that sequence of initials. If you cram that before the exam, you'll have the whole progress of cases, their names, holdings, and relation to one another. If it helps, you might break down each group of cases by general subject matter first (i.e., those related to contract formation, then those related to excuses for non-performance, and so on). That gives you a few, shorter phrases to remember as keys to the case-lists.

    Handing cases nationwide can be misleading - those television ads usually flash a little bit of small print at the end specifying that the advertised firm refers cases out. The advertised firm makes a fortune by referring cases to other firms.





    Every single legal case is different - you really can't compare one to the other. There are so many different factors to take into consideration! A good attorney will take the time to explain the pertinent law to you. That said, I've seen too many non-lawyers seriously screw up their own cases by taking advice from other non-lawyers, message boards, etc. Your lawyer really does have your best interests in mind - that's the law, after all!





    Visit a few different firms before deciding. If you are unhappy with your choice, you absolutely have the right to find another attorney.

    It depends on your state, but generally, he will file an appeal with the Court of Appeals. Depending on what and how he is appealing, the Court of Appeals will probably review what the judge did for ';abuse of discretion.'; Essentially, they are trying to determine if there was no reasonable basis for the judge to make the decision he made . . . this is generally pretty tough to do. There is another standard of review: de novo - which means the Court of Appeals looks at absolutely everything that was before the original judge.





    You should not expect a quick decision. This is a VERY slow process. He will file his motion through his attorney. You will file your reply through your lawyer. Then he can file another written response. The Court can decide the case based on the paper work OR can schedule your case for oral arguments. The Court will issue a written decision - and THIS also takes a bit of time.





    The last case I had that went through the appeals process involved a case that was decided by the lower court's judge in January 2008. The other side appealed.     In Criminal Law, there is no difference or conflict, per se. However, we still do have a reasonably independent judiciary in England, and conflicts can arise. Parliament passes legislation, but some of the laws that they pass are absurd (for example, under the Sexual Offences Act of 2003, it is a criminal offence for two 13 year olds to kiss) The Judiciary are able, thank goodness, to turn the law around by saying that, although this is the letter of the Law, was the kiss actually an assault, or simply behaviour that is natural among adolescents. Statute Law says that this is an offence, Case Law says - Oi, what is the background to the offence.





    I do know of people who have been convicted by passing a red traffic light to make way for an ambulance/fire engine - I do hope that someone who has enough money and nous will be done for this, so that he/she can take the case through the appeal process to the House of Lords and get a decent decision.

    Using the law to ensure that your rights are respected isn't grounds for discrimination. The only possible exception I could see to that was if the accused was in law enforcement.

    Although I have never had a lemon car, my brother-in-law is an excellent lemon law attorney here in California.





    Whenever he takes a new client, he drafts a demand letter to the manufacturer informing them that his client has hired him and he is demanding that they buy back the car. They are given 30 days or he files a lawsuit in court.





    The majority of his cases settle within four to six months - some sooner and some later. He has gained a reputation and a no-nonsense, no games lawyer who always represents his clients best interests - even if it means settling for less than the client could have received if it had gone to trial.

    I have just started studying law and need a brief, clear way of looking up law cases, precedents etc. in both paper and computer forms. The manual produced by the college was not too helpful! Would be happy if I just was told what steps to take in the paper form first as I don't always have access to a p.c.     First of all don't panic it is not as complicated as it looks.





    You initially need to identify the area of law you are looking at.





    Crim law, property law, Tort etc.





    Each case will have the parties concerned e.g smith v smith.





    As part of this the citation will immediately follow. So this then becomes smith v smith [1999] 1 All ER 225.





    The citation above means [The year] Volume 1. All England Law Reports. Paragraph 225.





    Some citations do not have a volume number. It may read


    [1999] Crim.L.R 512





    In this case it means [Year 1999] Criminal Law Reports at Paragraph 512.





    There are a number of letters that you will see in the citation.





    these are the reporting bodies, i.e who reported it. Here are a few for you.





    WLR = Weekly Law Reports


    QB = Queens Bench


    KB = Kings Bench


    AC = Appeal Court


    All ER = All England Law Reports


    T.L.R = Times Law Reports


    H.L = House of Lords





    There are many more but don't be put off.





    If there is a precident then the citation will look like this





    Smith v Smith [1999] 1 W.L.R. 275 at 277





    The number 277 is the paragraph where the words of the judge are that refer to the precident.





    For European law cases the citations are written differently.





    Pecastaing v Belgium (Case 98/79) [1980] ECR 691.





    Note the case number. it means case 98 in 1979. This is when the case went before the court. [1980] is when the final decision was made by the court.





    Almost all Law text books will have a list of cases in the front, just after the contents page. The cases will all look like the examples above and the pages where the case has been referred to.





    You will also see in the text a case name with a little number next to it. This tells you the footnote reference. If it is for cases you will see e.g smith v smith [1979] with the little number, then the citation either at the bottom of the page as a foot note, or at the end of the paragraph or section.

Customer in China buys one from Bob, and is injured by it in China, and wishes to sue Bob. Should Customer have to come to the U.S. to sue Bob, or should Bob have to go to China to defend himself?     Actually I disagree. The person in China may have the option to use either forum and sue in China. Most countries including the US have long arm statues which can compel people to appear in court in a different city, state, or county. What this would likely come down to would be if Bob is targeting Chinese's buyers, for example having a site in their language or advertising on popular Chinese sites, advertising shipping to that country, or simply doing a lot of business there. If the opposite were to happen, if it was a company in China selling products on the internet to American buyers then the American buyer would have the standing to sue in his local court and compel the company to appear.     Pretty much any law firm will do that.





    And yeah, the Chinese customer would have to sue in Bob's jurisdiction, because the law makes it pretty clear that the point of sale is where Bob is.





    The reason for that is that if the customer sued in China, and won, they'd have no way to collect, because a Chinese court can't compel Bob to do anything when he isn't in China. Only an American court can compel him to pay a judgment and punish him if he refuses.
    The suit would be have to be in the US (point of sale) and service of process obtained through the Hague Convention (although, I'm not too sure if China is a signatory of the Hague).

    If the ';mistake'; is paid in full promptly, the bank will probably let it go. Not paying promptly is generally considered confirmation of fraud. Banks are becoming far more aggressive in collecting these days -- they have to.





    Each bank determines their own criteria for pursuing fraud charges. And they are disinclined to discuss or publicize those criteria for obvious reasons. But banks (and other lenders) are definitely pursuing criminal charges on much smaller amounts than they did a year or two ago. And they are pushing prosecutors/district attorneys much harder to go after these.

    99% of the people I know, including myself just use word. There is a lot out there but I think they are just trying to get you to spend money for something you don't need, word has worked just fine for me for the past 2 1/2 years of law school.

    I'm not sure, but usually it's 1/3 of the judgment plus expenses. It's those ';plus expenses'; that tend to eat up the rest of your judgment and gives the lion's share to the attorney.

    This is an exercise in conciseness. The best way to learn is to read a lot of them. Look in your local library on the database LexisNexis, which has many, many different cases you can read. Read all the briefs you can.

    It was basically about due process.





    Someone was receiving welfare, but then the state decided that he was no longer eligible and told him that the payments would stop. He said, wait a minute, if you let me explain the circumstances, you'd see that I'm still eligible (it is called a ';hearing'; when someone is allowed to come in and tell their side of the story). The state said, fine, you can come tell us about the situation (we'll give you a ';hearing';), but first we are going to terminate the payments. If, after hearing your side of the story, we think you are still eligible, then we will start making the payments again. SO THE STATE OFFERED HIM A POST-TERMINATION HEARING.





    The guy thought that he should get a PRE-TERMINATION hearing, and that the welfare payments shouldn't be stopped BEFORE he was able to explain his side of the story. So he sued the state.





    The state argued that it would be too expensive and time consuming to give all welfare recipients a pre-termination hearing.





    The case went all the way to the Supreme Court. The Supreme Court decided that it was unfair to terminate the payments without first hearing the guy's explanation of why he was still eligible. The court said WELFARE RECIPIENTS MUST BE ALLOWED A PRE-TERMINATION ';HEARING'; BEFORE THEIR PAYMENTS ARE CUT OFF.





    Why? In the words of the court: ';The interest of the eligible recipient in the uninterrupted receipt of public assistance, which provides him with essential food, clothing, housing, and medical care, coupled with the State's interest that his payments not be erroneously terminated, clearly outweighs the State's competing concern to prevent any increase in its fiscal and administrative burdens.';

But as far as I know, and each state has its own rules and regulations, the answer would closely fit 33 1/3 % of the settlement.

    No, at most there is a prescribed fee for notarial fees and court awarded attorney's fees. Otherwise, an attorney can charge his clients as much as he believes that he's worth, i.e. the better the reputation of the lawyer - the more expensive he is.
    Not usually, no. There's no laws against anyone in any profession making as much money as people are willing to pay for their services.

    Try the Palsgraf case. Palsgraf v. Long Island Railroad Co., 162 N.E. 99 (N.Y. 1928). Dude with newspaper-wrapped parcel was running to catch the train and a railroad employee lent him a hand. In so doing the employee accidentally knocked the parcel to the ground. KABOOM!! Turned out there were fireworks in the parcel. The whole station started shaking for a few seconds. No harm no foul right? Wrong! The shaking caused by the explosion caused heavy metal scales, at the opposite end of the station, to topple. Right onto a little old lady called Mrs. Palsgraf. Well the old bird decided to sue. Couldn't find the passenger, who was long gone, and probably didn't have a dime. So she sued the railroad for negligence. Who won?     One that always bugged me was the guy who was trying to break into a place and he fell through a faulty skylight on the roof. The owner of the building lost in court when sued for damages to the guy who was trying to break in. he had to pay for medical and for damages - big money as guy became quadriplegic. I felt that he incurred injury in performance of a felony and should have been responsible for his own damages. The owner was found to be negligent as the skylight was faulty and he did not repair it. I felt had the burglar not been on the roof trying to get in he would not have been injured.





    Yet this became law. The owner was responsible. it is a travesty as far as I'm concerned.

    Probably one of the most profound was the Triangle Shirtwaist Factory fire in the early 1900's. It was a sweatshop employing mostly Jewish young women, that locked all their doors shut to prevent the workers from taking breaks. When a fire broke out, the women had no way to escape and many died horribly. It was a real tragedy. The resultant prosecution and civil lawsuits led to the passage of many workplace-safety laws and other protections for workers that we take for granted in America today.Jewish law cases that changed America?
    I'm frankly appalled at the ignorance in the first two answers. And to correct them: no Jews have ever 'lynched' anyone!Perhaps the answerer would care to provide a link...? No? Quelle surprise.





    And to correct what the second answer said: Jews make up less than 2% of the American populace. It would be frankly physically *impossible* for there to be a Jew ' in every' legal case. The notion is absurd.





    To the asker: is this an assignment? If not, what makes you think that there is ANY lawsuit involving Jews that have changed America? I'm just asking out of interest :)
    Just about every single civil rights law suit involves Jews in some way or another. Either the law firm, the judge, or some expert witness.
