Law - Cases of two employees killed whilst carrying out their business. Is driver covered by insurance.?

Two employees electricians driving to carry out a job for their employer. A truck hits them head on and both employees are killed instantly. The employer says that only the passenger will be covered by the insurance company not the driver. Is this the case in Scotland.





An inquest was held into the accident and no driving offence was committed. The accident was put down to low sun glare causing the driver of the van to cross his line and lead to the accident.Law - Cases of two employees killed whilst carrying out their business. Is driver covered by insurance.?
Hmmmm, thats a tough one, if the sun was low the driver could have put the sun visor does and sat up in his chair to block out the sun, but as he was not totally at fault and under the influence of alcohol or drugs or breaking the speed limit i dont see why the insurance would become void. There is something not right there!


Sounds like the employer is trying to pull a fast one becuase he would have to pay more for the driver than he would for the passenger!
