Case law and precedent are how laws are interpreted by the courts. Once a law has been enacted by legislature then any precedent involving that law is considered to be part of the law itself.


Case law is used to help guide a court when making a decision that poses questions that are not clearly defined by the law. In these circumstances counsel usually will provide some case law to the court as to why the judge should listen to their argument versus another.


Every criminal case has its own unique circumstances. Precedent on laws help to establish how the law is meant to be applied and case law is used to help decide how an issue should be handled.
