The classification of the law case?

I read an article on Toronto star about the embryo mix-up in the fertility clinic. Basically the careless doctor injected the wrong embryo into the woman, and so the woman bore other people's child.





Is that considered as tort law? If not, which private law category should it fall under?The classification of the law case?
This is definitely a case of medical malpractice.
